Effective April 6, 2026. These terms govern how you access and use SmartPost, including content creation tools, scheduling features, integrations, analytics, and workspace management.

Scope

These terms apply to individual users, teams, agencies, and organizations using SmartPost for their own accounts or client accounts.

Acceptance Of Terms

By accessing or using SmartPost, you agree to these Terms and Conditions. If you are using the platform for a company, agency, or client, you confirm that you are authorized to accept these terms on that party's behalf.

If you do not agree with these terms, do not use the service.

Accounts And Access

You are responsible for keeping your login credentials secure and for all activity that happens under your account. You must provide accurate information and keep it updated.

We may suspend or restrict access if we detect unauthorized use, abuse, fraud, or behavior that puts the platform, other users, or connected third-party services at risk.

Permitted Use

You may use SmartPost to draft, schedule, publish, and manage content for your own brands or accounts you are authorized to operate.

You may not use SmartPost to violate laws, impersonate others, distribute harmful or misleading content, interfere with the service, scrape unauthorized data, or misuse integrations with third-party platforms.

Third-Party Platforms

SmartPost may connect with services such as Instagram, TikTok, LinkedIn, X, YouTube, Discord, Telegram, and other external providers. Your use of those integrations is also subject to the terms and policies of those providers.

We are not responsible for outages, API changes, account restrictions, or policy enforcement actions taken by any third-party platform.

Billing And Plan Changes

Paid plans, feature limits, and pricing may change over time. If pricing changes affect your subscription, we will apply the updated pricing according to the billing rules communicated to you at sign-up, renewal, or upgrade.

Unless stated otherwise, fees already paid are non-refundable except where required by law.

Content And Data

You retain ownership of the content, brand assets, prompts, and data you submit to SmartPost. By using the service, you grant us the limited rights needed to host, process, generate, store, and transmit that content in order to operate the platform.

You are responsible for reviewing generated content before publication and for ensuring it is accurate, lawful, and appropriate for the destination platform and audience.

Availability And Changes

We may update, improve, suspend, or discontinue any part of SmartPost at any time. We aim to keep the service available, but we do not guarantee uninterrupted or error-free operation.

We may also revise these terms from time to time. Continued use of the platform after updates take effect means you accept the revised terms.

Limitation Of Liability

To the maximum extent permitted by law, SmartPost is provided on an as-is and as-available basis. We disclaim warranties that are not expressly stated.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, goodwill, or business opportunities. Our total liability for any claim relating to the service will not exceed the amount you paid to SmartPost in the twelve months before the event giving rise to the claim.

Termination

You may stop using the service at any time. We may suspend or terminate access if you violate these terms or if continued access creates legal, security, or operational risk.

Sections that reasonably should survive termination, including ownership, payment obligations, disclaimers, and liability limitations, will continue to apply.
